Terms of service
TERMS OF SERVICE
Effective date: Jun 11, 2026
Backland Expedition Gear Ltd. (“Backland”) provides products, fabrication, installation services, vehicle modifications, accessories, and related services subject to these Terms of Service and all applicable Backland policies.
By using this website, placing an order, approving a quote, booking work, submitting a work authorization, or purchasing from Backland, the customer agrees to these Terms of Service and all applicable Backland policies in effect at the time of sale.
Incorporated Policies
The following policies form part of these Terms of Service:
- Order Policies
- Installation & Vehicle Terms
- Limited Warranty
- Privacy Policy
- Website Disclaimer
If there is a conflict between these Terms and a more specific Backland policy, the more specific policy applies to that subject.
Orders & Acceptance
All orders are subject to acceptance by Backland.
Backland may refuse, pause, modify, or cancel any order if pricing, availability, fitment, safety, compliance, payment, customer information, or scope details are incomplete, incorrect, unavailable, unsafe, or cannot reasonably be verified.
Quotes, lead times, shipping dates, and installation dates are estimates unless expressly confirmed in writing by Backland.
Unless stated otherwise, quotes are valid for 30 calendar days from the quote date. Expired quotes are subject to revised pricing, availability, lead times, shipping costs, installation scheduling, and scope confirmation.
Pricing & Payment
Backland may correct pricing, clerical, technical, or inventory errors before accepting an order. Once an order is accepted, pricing will not change unless there is a scope change, customer-requested change, supplier or freight change, tariff, duty, tax, or other cost not included in the original quote.
Pricing, availability, and scheduling are not reserved until Backland accepts the order and receives any required deposit, payment, approvals, and customer information.
Installation bookings require payment of the required deposit, completion of Backland’s Work Authorization process, and approval of the final scope of work before installation work begins.
Backland may withhold shipment, release of products, release of vehicles, or continuation of work until required deposits, balances, approvals, or information are received.
The customer is responsible for all collection costs, chargeback costs, storage fees, legal fees, and recovery costs associated with unpaid balances to the extent permitted by law.
Customer Information
The customer is responsible for providing accurate contact, shipping, billing, vehicle, ownership, authorization, and fitment information.
Backland is not responsible for delays, incorrect parts, fitment issues, scheduling issues, or additional costs caused by inaccurate or incomplete customer information.
Product Information & Fitment
Product specifications, photos, fitment information, dimensions, instructions, availability, finishes, and weights may change without notice.
Unless Backland expressly confirms fitment in writing, the customer is responsible for confirming suitability for their vehicle, intended use, insurance requirements, and applicable laws.
Intellectual Property
Backland designs, drawings, photos, branding, website content, documentation, and related materials remain the property of Backland or its licensors and may not be copied, reproduced, distributed, reverse-engineered, or commercially used without written permission.
Limitation of Liability
To the fullest extent permitted by law, Backland is not liable for indirect, incidental, consequential, special, punitive, or economic losses, including:
- loss of use
- towing
- travel expenses
- rental vehicles
- lost income
- business interruption
- delay costs
- third-party costs
To the fullest extent permitted by law, and unless a greater remedy is required by applicable law, Backland’s total liability is limited to the amount paid for the specific product or service giving rise to the claim.
Nothing in these Terms limits liability where prohibited by law.
Force Majeure
Backland is not responsible for delays or failures caused by events outside its reasonable control, including but not limited to supplier delays, freight delays, weather, natural disasters, labour shortages, strikes, utility failures, border delays, government actions, pandemics, cyber incidents, or material shortages.
Governing Law
These Terms are governed by the laws of Alberta, Canada.
ORDER POLICIES
Effective date: Jun 11, 2026
These Order Policies apply to product sales, online orders, shipping, pickups, returns, refunds, and cancellations.
Shipping Timelines
Shipping and delivery dates are estimates only.
Backland is not responsible for carrier delays, customs delays, weather delays, freight delays, border delays, missed delivery, missed delivery appointments, or other delays outside Backland’s reasonable control.
Oversized Freight
Some products require freight shipping.
The customer is responsible for ensuring the delivery location can safely receive oversized freight shipments, including required access, unloading equipment, liftgate service, forklift access, loading dock access, or other delivery requirements.
Unless expressly included in the quote or invoice, the customer is responsible for all additional freight and delivery fees. Quoted freight includes only the freight services expressly listed on the quote or invoice. Any delivery services, access requirements, or carrier charges not disclosed to Backland before quoting, not included in the quote or invoice, or added by the carrier before or after delivery are the customer’s responsibility. This may include liftgate or tailgate service, residential delivery, limited-access delivery, remote-area fees, appointment fees, redelivery fees, storage fees, waiting-time fees, reconsignment fees, and other carrier charges.
Additional carrier fees may be charged to the customer before or after delivery if they are assessed by the carrier.
Rejected or Refused Shipments
If a customer refuses or rejects delivery without Backland’s prior written approval, or without a valid documented issue caused by Backland, the customer is responsible for all resulting costs.
These costs may include return shipping, re-shipping, carrier fees, redelivery fees, storage fees, brokerage fees, customs charges, insurance, and damage caused by additional handling.
If a shipment appears damaged on delivery, the customer should follow the Delivery Inspection process before refusing the shipment unless refusal is reasonably necessary due to severe damage or unsafe delivery conditions.
Backland will review refused or rejected shipments case by case. If refusal was required because of a confirmed Backland error or valid freight issue, Backland will determine the appropriate remedy.
Delivery Inspection
The customer must inspect all deliveries immediately upon receipt.
Shipping damage, missing items, incorrect items, packaging concerns, or visible product defects must be reported to Backland within 10 calendar days of delivery.
If a shipment appears damaged on delivery, the customer should notify the carrier immediately and ask the driver to note the damage on the delivery paperwork where possible.
The customer must keep all packaging, including boxes, padding, labels, pallets, and protective materials, until Backland confirms they are no longer required.
The customer must provide clear photos showing:
- the damaged packaging
- shipping labels
- any visible product damage or defect
- any incorrect item received
- the overall shipment condition
Photos and order details should be sent to shipping@backlandgear.com.
Failure to inspect promptly, keep packaging, provide photos, or report concerns within 10 calendar days may limit Backland’s ability to assist with missing-item, shipping-damage, or carrier claims.
Defective, damaged, or incorrect items must not be installed without Backland’s prior written approval. Installation of a product may be treated as acceptance of the product condition and may limit or void claims related to visible damage, defects, missing items, or incorrect items.
Duties, Tariffs & Import Costs
For shipments outside Canada, the customer is responsible for all duties, tariffs, brokerage fees, taxes, customs charges, and import-related costs.
Backland is not responsible for customs delays, border delays, seized shipments, or import restrictions.
Returns
Returns require prior written approval from Backland and a valid order number.

Returned products must be:
- Unused
- Uninstalled

No returns will be accepted for items priced under $30.00 unless approved by Backland in writing or required by law.

Approved returns not caused by Backland error are subject to a 5% restocking fee.
Refunds may be reduced for missing parts, missing packaging, damage, use, installation, cleaning, repackaging, or other condition issues.
Cancellations
Orders may be cancelled within 24 hours only if procurement, fabrication, coating, shipping preparation, installation preparation, or production has not started.
Orders cannot be cancelled once fabrication, coating, custom work, special-order purchasing, non-stock purchasing, or installation preparation has started unless approved by Backland in writing.
Approved cancellations not caused by Backland error are subject to a 5% cancellation fee.
If a cancellation is approved after costs have been incurred, the customer is responsible for all non-recoverable costs, including materials, special-order parts, non-stock parts, fabrication, coating, labour, shipping, carrier fees, supplier fees, and payment processing fees.
Refunds for approved cancellations are issued after Backland reviews the order status and incurred costs.
Backland may treat an order as abandoned if the customer fails to respond to reasonable requests for approval, payment, pickup, information, or scheduling for more than 60 days. Backland may cancel the order and retain amounts necessary to recover incurred costs, storage charges, administrative costs, and other non-recoverable expenses to the extent permitted by law.
In-Store Pickup
The customer is responsible for loading, transportation, handling, storage, unpackaging, repackaging, installation, maintenance, safe use, and legal compliance.
If the customer removes products from Backland packaging, declines packaging, or repackages products for transport, the customer is responsible for any resulting damage, loss, or handling issues.
Windows, glass products, and fragile products are sensitive to transport, handling, storage, and installation conditions. Once these products leave Backland’s custody without installation by Backland, Backland is not responsible for breakage, scratches, seal damage, handling damage, installation damage, storage damage, transport damage, leaks, wind noise, corrosion, or fitment issues caused by third-party handling or installation.
Product Pickup
Backland will notify the customer when products are ready for pickup.
Products must be picked up within 14 calendar days of notice unless otherwise approved in writing.
After 14 calendar days, Backland may return uncollected products to inventory and make them available for sale to other customers. Future availability is not guaranteed, and the customer may be subject to new product availability, production, procurement, or lead times.
Storage fees may apply to oversized, custom, special-order, or completed orders held beyond the pickup deadline.
